1. Who we are

These Terms of Service ("Terms") govern your use of digital courses and related learning materials offered under the WHALKER brand by WALKHER LLC ("WALKHER," "we," "us," or "Seller"). WHALKER is our public-facing brand; WALKHER LLC is the legal seller.

2. Acceptance of these Terms

By placing an order, accessing a course, or using any course materials, you agree to be bound by these Terms. If you do not agree, do not purchase or use our courses.

You must be legally able to make purchases in your jurisdiction. If you are under the age of majority, you may purchase or use a course only with the involvement and consent of a parent or legal guardian.

3. Platform and checkout

All purchases are processed through Whop. Whop provides the checkout, payment processing, and course-delivery platform. Whop is not the seller of WHALKER course content; WALKHER LLC remains solely responsible for the courses it offers.

When you purchase through Whop, you also agree to Whop's applicable terms of service and privacy policy. We encourage you to review those documents before completing a purchase. If any Whop term conflicts with these Terms regarding Whop's platform or payment services, Whop's terms govern those services.

4. Products and course information

We offer digital education relating to apparel brand development, garment design, sourcing and production, and retail launch. Course content, format, included materials, access period, prerequisites, and pricing are described on the applicable Whop product page at the time of purchase. That product page forms part of the offer.

Courses are educational in nature. They are not legal, tax, accounting, investment, manufacturing, or other professional advice. Results depend on individual circumstances and effort; we do not guarantee sales, profits, supplier acceptance, production outcomes, or business success.

5. Orders, pricing, and taxes

Orders are initiated through the Whop checkout link provided for a course. This website does not accept or process payments and does not collect or store payment-card details. Payment methods, security information, final price, currency, applicable taxes, and any available payment terms are displayed by Whop at checkout.

An order is subject to successful payment authorization. We may correct listing errors, cancel an order if we cannot fulfill it, or address suspected fraud or unlawful use, subject to applicable law. If an order is cancelled after payment, any refund will be handled in accordance with our Return Policy and applicable law.

6. Access and permitted use

After purchase, course access is provided through the method described on the applicable Whop product page or at checkout. Access is personal to the purchaser and may not be shared, resold, transferred, sublicensed, publicly posted, or used to provide competing training without our written permission.

You may use course materials for your own learning and business planning. You may not copy, record, redistribute, publish, or create derivative products from our materials except as permitted by law or with our written permission.

7. Intellectual property

All course content, videos, documents, templates, branding, logos, and other materials are owned by WALKHER LLC or its licensors and are protected by applicable intellectual-property laws. No ownership rights are transferred to you through a purchase. Unauthorized use of our intellectual property may result in termination of access and legal action.

8. Refunds and returns

All sales are subject to our Return Policy. Please review it before completing a purchase. Except where a refund or cancellation right is required by applicable law, digital course purchases are final and non-refundable after purchase or access is granted.

Contact us at support@whalker.shop promptly if you believe you were charged incorrectly, cannot access a purchased course, or need help with an order. Include your purchase email and order details. Do not email full card numbers or security codes.

9. Acceptable use

You agree not to:

• Share your course access credentials or access with others
• Copy, record, screen-capture, or redistribute course content
• Use courses or course materials to create competing products or services
• Interfere with platform security or access controls
• Use the website or courses for any unlawful purpose

We may suspend or terminate access for material breaches, fraudulent activity, or unlawful use, subject to applicable law.

10. Availability and changes

We may update or improve course materials and may temporarily limit access for maintenance or circumstances beyond our reasonable control. We will not materially remove paid course access during any access period specifically promised at checkout except where required by law, due to a security or legal concern, or where the course or platform is discontinued.

11. Disclaimers

Courses are provided for educational purposes. We make no warranties that any course will be error-free, uninterrupted, or produce specific results. To the maximum extent permitted by applicable law, all courses and materials are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by applicable law, WALKHER LLC's total liability arising out of or related to a course purchase or use of the website is limited to the amount you paid for the course giving rise to the claim.

To the extent permitted by applicable law, WALKHER LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunity arising from use of a course. Nothing in this section limits liability for fraud, willful misconduct, or other liability that cannot be limited by law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Ohio and applicable federal law, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts with jurisdiction in Van Wert County, Ohio. You may have rights to bring a claim in your place of residence that cannot be waived under applicable law.

14. Changes to these Terms

We may update these Terms by posting a revised version with a new "Last updated" date. Changes apply prospectively and do not reduce rights that cannot be changed after purchase under applicable law. Continued use of the website or courses after changes take effect constitutes acceptance of the updated Terms.
